Not if they have cookies turned off in their browser, in this case ShopSite
resorts to IP tracking. This is also true of the shopping cart itself (they
use basically the same mechanism, with the Associates feature it is just a
matter of when the cart is created and that it is created with the Associate
name in it).
There is also nothing that says you can't warn the shoppers in the content of
your page, or create a JavaScript pop-up warning that happens when they click
on the link
Basically, this would be up to the browser makers or the content providers,
there is no way for software running on the server to force the browser cookie
warning if the shopper has turned it off.
There is always SOMEONE trying to ban SOMETHING, so I wouldn't count on that
ever really become law. And if it did, how would it be enforced?

P.S. A 'policy' page that explains how your site uses cookies is always a good
thing to have anyway, along with policies on how you use the information they
enter into the shopping cart.
