Tax Question

Postby stilfx » Thu Aug 02, 2007 12:14 pm

I have someone who purchased and item from the same state as my clients retail (brick and mortar) store, but shipped it out of state. The final sale did not charge him/her sales tax because the tax is applied to the shipping zip code. Is that correct? It doesn't seem right, but then again I'm not a CPA.

You will need to contact a tax attorney for a definitive answer.

In general though tax cannot be charged for items shipped across a state boundary unless the merchant also has a presence it that state. This is interstate commerce and and regulated by the Federal Government not state governments.
